This is the transcript of the Judgment of Lord Justice Walker. I can only do 5 pages at a time, so you have to bear with me! I am leaving out some of the pages because I feel that they are not necessary to include them on the blog. Pages excluded include long (long!) citations, information of previous charity litigation...

Some of the pages omitted in this part are:

Pages 1-5 - Information about the British Diabetic Association (now trading under the name of Diabetes UK) - Who they are, when they were established, what their charitable objectives are...

Pages 8-9 - Information about other diabetic charities, including the Diabetes Foundation (we'll get back to that).

Up to page 20 - Information about previous charity passing-off litigation.

This is 3/4 of what Diabetes UK had spent sueing a diabetic family. They were heavily criticised by both Lord Justice Walker and the Lord Chief Justice Phillips in the High Court for the amount of charity money that they had wasted.

For example, Diabetic Society, The Diabetic Society, Diabetes Society, The Diabetes Society, Diabetic Society National, The Diabetic Society National... They purchased around 40 company names stopping anyone else from setting up a diabetic charity. All of these companies remain dormant.
